1. Agreement to Terms
These Terms and Conditions govern your access to and use of Tueely products and services, including MenuQR, MenuGPT, DigiTueeL, and the live demo at ai.tueely.com. By accessing or using Tueely, you agree to these Terms. If you do not agree, do not use the services.
2. Services We Provide
Tueely provides digital tools and services for restaurants and hospitality businesses, including:
- MenuQR: QR-based access to restaurant menus and related guest experiences.
- MenuGPT: AI-powered responses to menu-related guest queries.
- DigiTueeL: Digital presence support, such as website, content, and social media support.
- Live demos and product walkthrough experiences.
Features may evolve over time. We may update, improve, or discontinue features as part of normal product development.
3. Eligibility and Account Responsibility
You represent that you are authorized to act for your business and to provide the content, menu data, and materials submitted to Tueely. You are responsible for maintaining the confidentiality of any login access and for activity occurring under your account.
4. Your Content and Data
You retain ownership of menu content, branding assets, and business information that you provide. You grant Tueely a limited license to use, host, process, and display this content only as necessary to provide and support the services.
You are responsible for ensuring that submitted content is accurate, lawful, and does not infringe rights of third parties.
5. Acceptable Use
You agree not to:
- Use the services for unlawful, fraudulent, or deceptive purposes.
- Interfere with platform security, availability, or performance.
- Reverse engineer, scrape, or misuse the services beyond authorized use.
- Upload malicious code, harmful content, or unauthorized personal data.
- Use Tueely branding, trademarks, or content without permission.
6. AI Outputs and Menu Accuracy
MenuGPT responses are generated from the data provided and system behavior. While Tueely is designed for practical accuracy, AI output may occasionally be incomplete or incorrect. Restaurants remain responsible for final menu accuracy, allergen disclosures, pricing, and guest safety communications.
7. Fees, Billing, and Payments
Paid services, if applicable, are billed according to your chosen plan or written agreement. Unless otherwise stated in writing, fees are non-refundable. You are responsible for taxes or duties applicable to your purchase under local law.
8. Intellectual Property
Tueely and related software, design, documentation, and branding are owned by Tueely or its licensors and protected by intellectual property laws. These Terms do not grant ownership rights, only a limited right to use the services as permitted.
9. Availability and Changes
We aim for reliable availability but do not guarantee uninterrupted service. We may perform maintenance, apply updates, or modify service functionality. We are not liable for temporary downtime caused by planned maintenance or events outside our reasonable control.
10. Termination
Either party may terminate service access according to the applicable plan terms or written agreement. We may suspend or terminate access for material violations of these Terms, misuse of the services, or legal compliance reasons.
11. Disclaimers
Services are provided on an "as is" and "as available" basis, except where prohibited by law. To the fullest extent permitted by law, Tueely disclaims implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, Tueely will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption. Total liability for claims related to the services is limited to amounts paid by you to Tueely in the 12 months preceding the event giving rise to the claim.
13. Governing Law
These Terms are governed by applicable laws in the jurisdiction where Tueely operates, unless otherwise required by mandatory local law. Disputes should first be addressed in good-faith discussions before legal action.
